Title Search & Due Diligence for clients in Germany

Indians in Germany, used to the certainty of the Grundbuch, are often surprised by how much checking is needed before buying property in India.

Title Search & Due Diligence for clients in Germany
In short

A title search for a Germany-based buyer examines at least thirty years of ownership history, encumbrances, revenue and municipal records, approvals, RERA registration and litigation. Our team inspects the records in India and sends a written report in English, so you can decide before transferring money from Germany. No German notarisation or legalisation is needed for the search itself.

German notary, pre-certification, then Indian mission attestation
Time difference
India is 3.5 hours (summer) to 4.5 hours (winter) ahead

Title Search & Due Diligence from Germany: how it works

You send scans of the seller's or builder's documents. Our team takes certified copies from the sub-registrar and revenue offices, checks court records and, for new projects, reviews the builder's RERA registration, sanctioned plans, completion status and any project loan. For resale property, we check society dues and whether a bank holds the original deeds. We discuss the findings on a call at a time that suits your German working day.

The report explains the title chain and each defect with a practical cure, such as a release deed from a co-heir or rectification of a revenue entry. If you proceed, we draft the agreement so that payments depend on those cures and complete the purchase through a legalised power of attorney. Payment should travel by bank transfer from Germany or your NRE account so the purchase is repatriable later. If you plan to visit India during your German holidays, we can arrange a site inspection and a meeting with the seller then, so you see the property before the final payment.

What clients in Germany should know

  • Germany's Grundbuch gives public faith to registered title; Indian registration records do not, so the chain of deeds must be examined.
  • An Indian bank's legal report for a home loan protects the bank, not your entire title.
  • Keep the title report; it simplifies a later sale or inheritance.
