A resident of Oman can buy or sell property in India through a power of attorney notarised in Oman and apostilled by the Omani Ministry of Foreign Affairs, or signed at the Embassy of India in Muscat. The attorney holder signs and registers the deed. Purchases are paid from NRE, NRO or FCNR accounts or by inward remittance; on a sale, the buyer deducts tax at source and the proceeds go to your NRO account for repatriation.

Buying & Selling Property from Oman: how it works
We start with documents: for a purchase, a title search, encumbrance check and approvals review; for a sale, a check that your title, mutation and taxes are clear. We draft a sale agreement and a property-specific power of attorney, which you sign before a notary in Muscat or Salalah and have apostilled, or sign at the Embassy. Scans let us move ahead while the original travels to India, where it is stamped within three months and, for some states, registered or authenticated.
On a purchase, the attorney signs the deed and attends the sub-registrar; payment goes by banking channels, never cash. On a sale, the buyer obtains a TAN and deducts tax, and applying for a lower deduction certificate before closing can protect your cash flow. The net proceeds reach your NRO account and can be repatriated to Oman within the USD 1 million annual limit with Forms 15CA and 15CB. Agricultural land and farmhouses remain off limits to OCI cardholders.
What clients in Oman should know
- An Omani apostille is generally accepted by Indian registrars, but a few offices still ask about it; we confirm local practice before you sign.
- Gains on selling Indian property remain taxable in India under the India-Oman treaty, whatever your position in Oman.
- If you bought the flat with rial remittances, keep those records: they support repatriating the sale proceeds of up to two residential properties.

Questions from clients in Oman
Can my sister in India sign the sale deed for me?
Yes, using a specific power of attorney apostilled in Oman or attested at the Indian Embassy, stamped in India within three months.
Can I pay for a new flat directly from my Omani bank?
Yes, by inward remittance to the seller's or builder's account in India, or via your NRE account. Keep the remittance proofs.
Do I need to visit India for the registration?
Not if your attorney signs. Some clients prefer to sign in person during a trip, which is also possible.
