A person living in New Zealand can usually complete Indian legal work without travelling. Documents are signed before a New Zealand notary public and apostilled by the Department of Internal Affairs, then sent to India and stamped within three months. Your attorney holder or our team handles the Indian office or court. New Zealand is a reciprocating territory, so a money decree from a notified New Zealand superior court can be executed in India under section 44A.

The matters Indian New Zealanders bring to us
Indian migration to New Zealand accelerated with skilled migrant and student pathways, adding Punjabi, Gujarati, Telugu, Malayali and Tamil families to an older community that includes many people of Fijian Indian heritage. The newer arrivals usually have parents and property in India; the older community more often needs help with documents that prove family history or with OCI questions.
The work we receive from New Zealand includes selling a flat or plot in India, recording inherited land in the heirs' names, registering a marriage solemnised in India so it can be used for a New Zealand partner visa, and divorces where a marriage made in India breaks down in Auckland. A distinctive point for New Zealand is that its court judgments can be executed in India, which makes enforcing a foreign judgment in India realistic against a debtor who has returned home.
Signing and apostilling documents in New Zealand
New Zealand and India are both members of the Hague Apostille Convention. A New Zealand document for India usually follows this path:
- Sign before a notary public in New Zealand. Notaries are experienced lawyers appointed by the Archbishop of Canterbury's Faculty Office, and many work in Auckland and Wellington. A Justice of the Peace witness is not suitable for documents that need an apostille for India.
- Send the notarised document to the Authentications Unit of the Department of Internal Affairs, which issues the apostille. Public documents such as New Zealand birth, death and marriage certificates can be apostilled directly.
- Courier the original to India, where it must be stamped within three months of arrival and, for property powers, authenticated or registered where the state requires.
Indian passport holders can also sign before the consular officer at the High Commission of India in Wellington, though many Indian New Zealanders are now New Zealand citizens with OCI cards and use the notary route. We tell you which format the Indian office expects before you sign.
Most requested services from New Zealand
These six services account for most of our New Zealand work. Each page explains how to handle the matter from New Zealand, beginning with the notary and DIA apostille and ending with what the Indian office or court needs.
Buying & Selling Property
Settled migrants often sell property in India to fund a New Zealand home, or buy in India for parents or for a future return.
Mutation & Transfer
Land inherited from parents usually has to be moved into the heirs' names before it can be sold, rented or protected.
Marriage Registration
Immigration New Zealand and other authorities expect proof of a valid marriage, and an Indian marriage certificate is the cleanest evidence.
Divorce for NRIs
Couples who married in India often need an Indian decree, because a New Zealand dissolution may not be recognised in India.
OCI Card Issues
Many New Zealand citizens of Indian origin, including some with Fijian Indian family histories, need advice on OCI eligibility, renewal and cancellation.
Enforcing Foreign Judgments
New Zealand money decrees can be executed in India under section 44A, which helps creditors pursuing someone who has returned to India.
The India-New Zealand tax treaty and money transfers
India and New Zealand have a double taxation agreement that allocates taxing rights and lets New Zealand residents claim credit for Indian tax on Indian income. New Zealand taxes its residents on worldwide income, so rent from a flat in Ahmedabad or interest on an NRO deposit appears in both systems. New Zealand has no general capital gains tax, but its bright-line and other rules on property can still apply, so your New Zealand accountant should see any Indian property sale.
In India the buyer of your property deducts tax at source at non-resident rates. Money held in an NRO account can be remitted to New Zealand up to USD 1 million per financial year with Forms 15CA and 15CB, while NRE balances remain freely repatriable. Our property buying and selling page explains the Indian steps in more detail.
New Zealand judgments, divorce and family orders in India
New Zealand is one of the few countries notified by India as a reciprocating territory under section 44A of the Code of Civil Procedure. A money decree of a notified New Zealand superior court can be filed for execution in an Indian district court with a certified copy and a certificate of the amount still unpaid, without a new suit. Decrees for taxes, fines and penalties are excluded, and the judgment debtor can still resist execution on the grounds listed in section 13.
Divorce is different. A New Zealand dissolution under the Family Proceedings Act 1980 rests on two years of living apart, a ground that does not match the Hindu Marriage Act. Indian courts apply the Narasimha Rao test, so a dissolution granted against a spouse who did not participate may not be recognised in India. Many couples married in India therefore prefer an Indian mutual consent divorce. In custody disputes, New Zealand is a Hague Child Abduction Convention country while India is not, which shapes the remedies available.
Practical points for clients in New Zealand
New Zealand has the largest time gap with India of any of our client countries in this region: six and a half hours in the New Zealand winter and seven and a half in summer. An 8 pm call in Auckland is 12.30 or 1.30 pm in India, which allows same-day contact with Indian offices. Morning in India corresponds to your afternoon.
Indian courts routinely allow video appearance for parties abroad, and many family courts record mutual consent statements remotely. Courier from New Zealand to Mohali generally takes six to ten working days, so we review scans first. If you also have ties to Australia, our Australia page explains the different position for Australian judgments.

Frequently asked questions
Who issues apostilles in New Zealand?
The Authentications Unit of the Department of Internal Affairs. It apostilles documents signed by a New Zealand notary public and certain public officials, as well as official certificates.
Can a New Zealand court judgment be enforced in India?
Yes, if it is a money decree from a superior court notified under section 44A. It is filed for execution in the Indian district court, and the debtor can only raise the limited section 13 objections.
Is my New Zealand dissolution of marriage valid in India?
It may not be, particularly if your spouse did not take part or you married under an Indian Act that does not recognise separation alone as a ground. We review the order and advise whether an Indian decree is needed.
Can I register my Indian marriage while living in New Zealand?
Registration under the Hindu Marriage Act or the state rules generally requires both spouses to appear before the registrar, though some states allow video verification. We check the current rule for the relevant district.
Does India tax my New Zealand salary?
Not if you are a non-resident of India. India taxes non-residents only on Indian income, such as rent, interest and capital gains on Indian assets.
I am a New Zealand citizen of Fijian Indian descent. Can I get an OCI card?
Eligibility depends on whether a parent, grandparent or great-grandparent was an Indian citizen on or after 26 January 1950, or eligible to be, and on any special extensions announced for particular countries. Ancestry from before 1947 alone may not be enough, so we review your documents.
How long does a courier from Auckland to India take?
Typically six to ten working days. Send originals only after we confirm the scanned copy is complete and correctly signed.
Can I sell my Indian flat without coming to India?
Yes. A New Zealand notarised and apostilled power of attorney lets a relative or other trusted person sign and register the sale for you.
