Tenant Eviction for clients in Oman
In short

A landlord in Oman can evict a tenant in India through the rent controller or civil court under the state's rent law. Punjab and Chandigarh give eligible NRI owners a special procedure for own use, while Gujarat, Maharashtra and Kerala have their own statutes and grounds. You appoint an attorney holder by a power of attorney apostilled in Oman, and we run the case.

Document route
Omani notary public (Ministry of Justice and Legal Affairs), then apostille from the Omani Ministry of Foreign Affairs
Time difference
IST is 1h30 ahead of Oman time all year (no daylight saving)
Punjab NRI right
Section 13-B, East Punjab Urban Rent Restriction Act 1949
Without rent control
Notice under section 106, Transfer of Property Act

Tenant Eviction from Oman: how it works

We review the agreement, its registration and the rent record, then identify the governing law, such as the Maharashtra Rent Control Act for Mumbai or the Gujarat rent law for Ahmedabad. A legal notice terminates the tenancy and demands arrears. Grounds like arrears, subletting, damage or bona fide requirement are pleaded under the relevant statute, and the NRI own-use provision is used for Punjab and Chandigarh properties where it applies.

The petition is filed with ownership and tenancy evidence. Courts usually direct deposit of arrears and ongoing rent, which often prompts a negotiated exit. Where the tenant contests, your affidavit is filed from Oman with video testimony where the court permits. After the order, execution restores possession, and we draft a registered leave and licence or rent agreement for the next occupant. If the tenant offers to vacate in exchange for time or a partial waiver of arrears, we negotiate the terms and have them recorded by the court, which makes them enforceable without a fresh case.

What clients in Oman should know

  • In Maharashtra, a registered leave and licence agreement gives landlords a stronger position than an informal tenancy.
  • Tenants paying rent to a non-resident must deduct tax at source.
  • Rental income from India is taxed in India.
