Criminal Defence & Look Out Circulars for clients in the UAE

UAE-based Indians most often face Indian criminal complaints arising from matrimonial disputes, cheque bounce cases linked to family business, or property quarrels, and many learn of them only when stopped at an Indian airport.

Criminal Defence & Look Out Circulars for clients in the UAE
In short

If a case is filed against you in India while you live in the UAE, you can seek anticipatory bail and, where the FIR is an abuse of process, ask the High Court to quash it. Your advocate acts through a vakalatnama attested in the UAE. If a Look Out Circular has been issued, it can be challenged before you travel, so that a visit home does not end at the immigration counter.

Criminal Defence & Look Out Circulars from the UAE: how it works

We obtain the FIR and check the offences under the Bharatiya Nyaya Sanhita with the old IPC equivalents, any summons or warrant, and whether a Look Out Circular exists. For UAE residents we usually move for anticipatory bail under section 482 BNSS, the provision that replaced section 438 of the old CrPC. Courts may require you to join the investigation, which can be arranged during a planned visit once interim protection is in place.

Where the case is baseless or the parties have settled, we petition the High Court under section 528 BNSS (formerly section 482 CrPC) for quashing. We also handle passport impounding and permission to travel back to the UAE, which matters for keeping your job and residence visa. Because the UAE is close to India, clients can often make short trips for court dates, and we time those carefully with the court's schedule.

What clients in the UAE should know

  • A Look Out Circular can stop you leaving India after a visit, which can cost you your UAE job; check before you travel.
  • Cheque bounce complaints under section 138 of the Negotiable Instruments Act often settle with a payment plan approved by the court.
  • An Indian criminal case does not by itself affect your UAE residence, but a passport impounded in India does.

Questions from clients in the UAE

Can I apply for anticipatory bail while in Dubai?

Yes. Courts entertain such applications, often with conditions such as joining investigation on arrival.

Will I be stopped at the airport?

Only if a Look Out Circular or warrant exists. We check discreetly before you travel.

Can my in-laws' dowry case against my family be quashed?

Where allegations against relatives are vague or the dispute is settled, High Courts frequently quash proceedings.
