From the UAE you can recover money in India through a legal notice, a cheque bounce complaint under section 138 of the Negotiable Instruments Act, a summary suit under Order XXXVII CPC or an ordinary civil suit, depending on the paperwork. You sign a vakalatnama and power of attorney at the Indian mission or through MOFA attestation. If you already hold a UAE court judgment, it can often be executed directly in India because the UAE is a reciprocating territory.

Money Recovery from India from the UAE: how it works
First we look at the evidence: bank transfers from your UAE account, WhatsApp messages, any promissory note or agreement, and cheques given by the borrower. A demand notice from an Indian advocate often brings a response. If a cheque has bounced, the complaint must be filed within strict time limits after the notice period ends, so send the cheque return memo to us promptly. You sign the authority documents at the Embassy or Consulate, or appoint a relative in India as your attorney to give evidence where personal knowledge allows it.
Where no cheque exists, a summary suit on a written acknowledgment of debt is faster than an ordinary suit. Courts may order attachment before judgment if the debtor is selling assets. If you already obtained a judgment from Dubai Courts or another notified UAE court, we file an execution petition under section 44A instead of starting again. Watch the limitation period: a suit for money lent is generally within three years, though a written acknowledgment signed before expiry restarts it.
What clients in the UAE should know
- Transfers through UAE exchange houses leave a reliable paper trail; keep the receipts, because cash handed over in person is much harder to prove.
- A UAE criminal case for a dishonoured cheque does not bind an Indian court, but a UAE civil money judgment from a notified court can be executed in India.
- If the borrower also owes money in the UAE, check whether a UAE travel ban or case is pending, because that affects where recovery is most effective.

Questions from clients in the UAE
My friend gave me a cheque in Dubai drawn on an Indian bank. Can I file in India?
Yes. A cheque drawn on an Indian bank that is dishonoured can found a complaint under section 138, filed where your collecting bank branch is located, subject to the notice and time limits.
Is it better to sue in the UAE or in India?
If the debtor and assets are in India, an Indian action is usually more direct. If you already have a UAE judgment, executing it under section 44A can be quicker than a new suit.
Will I have to come to India to give evidence?
Often not. Evidence can be given by affidavit and cross-examination can be by video, subject to the court's directions.
