Divorce for NRIs for clients in Oman
In short

An NRI in Oman can obtain a divorce in an Indian family court, by mutual consent or contested, under the personal law governing the marriage. The spouse in Oman signs the petition and affidavits before an Omani notary with an apostille, and many family courts allow appearance by video. For Muslim marriages, talaq in its recognised form, khula and mubarat are available, but instant triple talaq is void.

Document route
Omani notary public (Ministry of Justice and Legal Affairs), then apostille from the Omani Ministry of Foreign Affairs
Time difference
IST is 1h30 ahead of Oman time all year (no daylight saving)
Main laws
Hindu Marriage Act 1955, Special Marriage Act 1954
Mutual consent
Section 13B, after 1 year of separation

Divorce for NRIs from Oman: how it works

For Hindu, Sikh, Jain and Buddhist couples, mutual consent under section 13B of the Hindu Marriage Act is usually fastest; the six-month cooling-off period can be waived in suitable cases following Amardeep Singh (2017). Special Marriage Act couples use its parallel provision, and Christian couples the Divorce Act 1869. Maintenance, custody, return of jewellery and property division are recorded in one settlement.

For Muslim couples, Indian law recognises talaq pronounced in the proper form, khula and mubarat, and a wife may seek divorce under the Dissolution of Muslim Marriages Act 1939. The 2019 Act makes instant triple talaq void and an offence. We explain the right route and arrange apostilled signing in Oman and video appearance so the spouse abroad loses as little working time as possible. Where the couple has a child, we also prepare a parenting plan that covers visits during the spouse's leave from Oman and video contact in between.

What clients in Oman should know

  • A divorce granted in Oman between Indian nationals may face recognition questions in India; an Indian decree avoids that risk.
  • A wife in India can claim maintenance under section 144 BNSS against a husband in Oman.
  • Hearings needing personal presence can often be fixed during annual leave.
