Divorce for NRIs for clients in Kuwait
In short

An NRI in Kuwait can obtain a divorce in an Indian family court, by mutual consent or contested, under the personal law of the marriage. The spouse in Kuwait signs the petition and affidavits through the Kuwaiti attestation chain or at the Embassy of India, and many family courts allow video appearance. Muslim couples can use talaq, khula or mubarat in recognised forms, but instant triple talaq is void.

Divorce for NRIs from Kuwait: how it works

For Hindu, Sikh, Jain and Buddhist couples, mutual consent under section 13B of the Hindu Marriage Act is the usual route; the six-month wait can be waived in suitable cases following Amardeep Singh (2017). Christian couples, numerous among Kuwait's Keralite community, proceed under the Divorce Act 1869, where mutual consent under section 10A requires a minimum period of living apart, a requirement some High Courts have relaxed. Maintenance, custody, return of gold and property division are recorded in the settlement.

For Muslim couples, Indian law recognises talaq given in the proper form, khula and mubarat, and a wife may seek divorce under the Dissolution of Muslim Marriages Act 1939. The 2019 Act makes instant triple talaq void and punishable. We explain the right route and arrange signing in Kuwait and video appearance so the spouse abroad does not lose working days.

What clients in Kuwait should know

  • A divorce granted in Kuwait between Indian nationals may face recognition questions in India; an Indian decree avoids them.
  • A wife in India can claim maintenance under section 144 BNSS against a husband in Kuwait.
  • Christian divorce by mutual consent under section 10A needs a prior period of separation; we check the current position in the High Court of your state.

Questions from clients in Kuwait

Can we get a mutual divorce while I work in Kuwait?

Yes. The joint petition is signed in Kuwait and attested, and most family courts let the spouse abroad record a statement over video.

Is instant triple talaq valid?

No, it is void and an offence under the 2019 Act.

How long does a Christian mutual divorce take?

Once the separation requirement is met, usually several months, depending on whether the court insists on the statutory waiting period or waives it.
