An Indian national in Kuwait can sign a power of attorney before the consular officer of the Embassy of India in Kuwait City, usually through its outsourced service centres. Otherwise the power is authenticated by the Kuwaiti Ministry of Justice, attested by the Kuwait Ministry of Foreign Affairs and then attested by the Embassy. In India it must be stamped within three months of arrival and, for property transfers, registered or authenticated where the state requires.
- Document route
- Kuwaiti Ministry of Justice notarisation, Kuwait Ministry of Foreign Affairs attestation, then Embassy of India attestation
- Time difference
- IST is 2h30 ahead of Kuwait time all year (no daylight saving)
- Recognition
- Section 33, Registration Act 1908
- Authentication
- Indian mission, or notary plus apostille
Power of Attorney from Kuwait: how it works
We draft the power around a specific task and describe property exactly as the title deed and revenue record do. You take the printed draft, your passport and civil ID copies and photographs to the service centre and sign before the Embassy's officer, who attests your signature. If you use the Kuwaiti route, the Ministry of Justice may require an Arabic version, and the foreign ministry and Embassy steps follow in sequence, so allow extra time.
Once the original arrives, your attorney gets it adjudicated and stamped with the stamp authority or sub-registrar within three months. Property sale or gift powers may also need registration or authentication under the Registration Act, and some states now ask for the attorney to file an affidavit that the principal is alive. We check what the particular office expects before you sign. When the task is complete, revoke the power by a deed attested in the same way.
What clients in Kuwait should know
- Kuwait's Ministry of Justice may issue its notarial certificate only in Arabic; ask for an English translation to be attached so Indian offices can read it.
- The Embassy attests the identity and signature of the executant, not the legal effect of the power, so a badly drafted power can be attested and still be refused in India.
- Powers signed years ago in Kuwait for one purpose should not be stretched to new transactions; registrars increasingly ask for fresh, specific powers.

Questions from clients in Kuwait
How long does Embassy attestation take in Kuwait?
Often a few working days, though it depends on the season and the service centre's workload.
Can I sign the power in Kuwait and my wife sign hers in India?
Yes. Each executant signs where they live, and the documents are used together in India.
Does the attorney need to be a relative?
No. Any trusted adult can be appointed, though some offices look more closely at powers in favour of non-relatives for property sales.
