Power of Attorney for clients in South Africa
In short

Draft the power of attorney to match the purpose, sign it before a South African notary and obtain an apostille from a High Court registrar. Courier the original to India, where it is stamped within three months and, for property transactions, registered or authenticated under the Registration Act. Indian citizens can alternatively sign at the High Commission in Pretoria or a Consulate General. Allow two to three weeks end to end.

Power of Attorney from South Africa: how it works

We ask what the attorney holder must do and in which state, because stamp duty, registration rules and the form of the power differ. A specific power naming the property and the transaction is generally needed for a sale, while a general power can cover rent collection and day-to-day matters. You sign before a South African notary with your passport, and the notary attaches a notarial certificate. The High Court registrar in your province then adds the apostille.

In India, the attorney holder pays stamp duty under the state law and, for immovable property, presents the power to the sub-registrar for registration or authentication. Some sub-registrars ask for the principal's photograph and fingerprints on the document, which the South African notary can witness. Banks often have their own mandate forms and may not accept a general power, so check with the bank first. A power of attorney ends automatically on the death of the principal.

What clients in South Africa should know

  • South African notaries charge professional fees that vary; ask for a quote that includes the notarial certificate and apostille.
  • If you hold South African citizenship and are a person of Indian origin, mention it in the power, since it affects the agricultural land rules.
  • Revoke any older power of attorney expressly and inform the bank and sub-registrar to prevent misuse.

Questions from clients in South Africa

Can I sign at the Consulate in Durban instead of a notary?

Yes, if you are an Indian citizen and the Consulate offers the service. Check the appointment process on its website.

Does the apostille have to come from the High Court?

For notarised documents, usually yes. Public documents issued by national departments are apostilled by DIRCO in Pretoria.

How quickly can my brother sell my land in India after I sign?

Once the original reaches India and is stamped and registered, often within a week, the sale can proceed, subject to the buyer's own checks.
