Indian lawyers for clients in Ireland

Indian legal services for clients in Ireland

Ireland's Indian community has grown quickly, built largely around technology, healthcare and pharmaceuticals. Most clients are working professionals who need Indian paperwork done properly and quickly: a power of attorney, a flat purchase, a marriage certificate or an Indian company for their employer.

In short

People living in Ireland can get most Indian legal work done remotely. Documents are signed before an Irish notary public and apostilled by the Department of Foreign Affairs, then couriered to India and stamped within three months. Ireland is not a reciprocating territory under section 44A CPC, so Irish judgments need a fresh suit in India. India and Ireland have a tax treaty that helps avoid double taxation of Indian income.

Indian professionals in Ireland and what they need

The Indian community in Ireland is younger and more recent than in Britain. Many came on Critical Skills Employment Permits to work in software, data, finance and pharmaceuticals around Dublin, Cork, Galway and Limerick, and a large number of doctors and nurses work in the Irish health service. Many are now Irish citizens or long-term residents, while keeping a flat, savings and parents in India.

Their needs are practical. A power of attorney so a parent can handle a property sale; buying a flat in Hyderabad or Kochi; registering an Indian marriage so a spouse can join them in Ireland; setting up an Indian subsidiary for an Irish employer; and filing Indian tax returns on rent or interest. These are usually not disputes but transactions, and the priority is getting the documents right first time.

Signing and apostilling documents in Ireland

Ireland and India are both parties to the Apostille Convention, so Irish documents need an apostille, not embassy legalisation. For a power of attorney or affidavit, sign before an Irish notary public, most of whom are also practising solicitors. The notary's signature is then apostilled by the Department of Foreign Affairs, which runs an authentication service and accepts postal applications.

Irish civil certificates of birth, marriage or death are issued through the civil registration service and can be apostilled for India. For documents travelling the other way, such as an Indian marriage or degree certificate for Irish immigration or employment, the Ministry of External Affairs in New Delhi issues the apostille after state verification. Our apostille and attestation page explains both directions.

Most requested services from Ireland

These six services cover most of what clients in Ireland ask us for. They are mostly transactional: getting documents right, completing a purchase or registration, and staying compliant with Indian tax and company law.

Irish tax, the treaty and Indian income

India and Ireland have a tax treaty that allocates taxing rights and gives credit for tax paid in one country against tax in the other. Irish residents generally report Indian income and gains to Revenue. Individuals who are resident but not domiciled in Ireland may be taxed on some foreign income only when it is remitted to Ireland, which can change how Indian rent or interest is treated; that is a question for an Irish tax adviser.

In India, a non-resident is taxed only on Indian-source income. Interest on NRE deposits is exempt in India, while NRO interest and rent are taxable, and tax is deducted at source. See NRI income tax for the Indian filing, and plan property sales with repatriation in mind: NRO balances can be repatriated up to USD 1 million per financial year with Forms 15CA and 15CB.

Irish judgments, marriages and family matters

Ireland is not a reciprocating territory, so an Irish money judgment is enforced in India only by filing a fresh suit based on it, and the defendant can raise section 13 CPC objections. Commercial parties often prefer arbitration clauses, because India and Ireland are both parties to the New York Convention and foreign awards are enforced under Part II of the Arbitration and Conciliation Act.

For families, the common issue is marriage documentation. A marriage solemnised in India should be registered there, under the Hindu Marriage Act, the Special Marriage Act or the relevant state law, to give a certificate that Irish immigration authorities accept. Marriages in Ireland require advance notice to a civil registrar. Divorce recognition follows the same Indian principles as for other foreign decrees, under Narasimha Rao. See our UK page for comparison with a reciprocating neighbour.

Working with us from Ireland

India is four and a half hours ahead during Irish summer time and five and a half hours in winter. A lunchtime call in Dublin is late afternoon or early evening in India, which suits busy professionals. Courier from Ireland to India usually takes five to seven working days.

Because most Irish matters are transactional, we work to fixed checklists: draft, sign, apostille, courier, stamp, register. We send you a signing pack with clear instructions for the notary, which prevents the most common delay, a document returned from India for a missing page signature, photograph or thumb impression.

If you are planning to move back to India, talk to us before you do. The timing of the move affects your residential status for Indian tax, the conversion of NRE and NRO accounts, and whether property sales are better completed while you are still non-resident. A short planning call can avoid unnecessary tax and paperwork.

Irish citizens of Indian origin should also keep their OCI details current. A new Irish passport means the OCI record needs updating in certain cases, and Indian banks and registrars increasingly check that the OCI and passport numbers on file match.

Frequently asked questions

Who issues apostilles in Ireland?

The Department of Foreign Affairs, through its authentication service. Documents are usually notarised by an Irish notary public first.

Can I sign at the Indian Embassy in Dublin instead?

Indian nationals can have documents attested at the Embassy. Most clients find the notary and apostille route straightforward, especially Irish citizens.

Can an Irish court judgment be enforced in India?

Only by a fresh suit, because Ireland is not a reciprocating territory. Arbitration awards are easier to enforce under the New York Convention.

Can Irish citizens of Indian origin buy property in India?

With an OCI card, yes for residential and commercial property, but not agricultural land, plantations or farmhouses.

Does Ireland tax my Indian rent?

Generally Irish residents report foreign income, with credit for Indian tax under the treaty. Non-domiciled residents may be taxed on a remittance basis for some income.

How do I register my Indian marriage from Ireland?

If the marriage took place in India, the application can often be made with the help of an attorney holder, though some registrars require both spouses to appear in person or by video.

How long does courier from Ireland take?

About five to seven working days with an international courier. Keep scans and tracking details.

Do I need an Indian PAN while living in Ireland?

Yes, if you have Indian taxable income, own property or invest. PAN can be applied for from abroad.
