In short

People in Trinidad and Tobago can complete most Indian legal work remotely. Documents are signed before a notary or attorney-at-law and apostilled, since both countries are parties to the Apostille Convention, then couriered to India. Trinidad and Tobago is also a reciprocating territory under section 44A of the Code of Civil Procedure, so a money decree from its superior courts can be executed in India directly, without a fresh suit.

Two Indian communities with different legal needs

Most Indo-Trinidadians descend from indentured labourers brought from India between 1845 and 1917, largely from what are now Uttar Pradesh and Bihar. Families in Chaguanas, San Fernando, Couva and across central and south Trinidad keep that heritage through religion, food and language, and many now want formal recognition through an OCI card. For this group the legal questions are usually about proving ancestry and documenting identity, rather than property in India.

A second, smaller community arrived more recently: professionals, doctors, engineers and traders, some of Sindhi or Gujarati background, who still have parents, bank accounts and property in India. Their needs look more like those of NRIs elsewhere: estates, mutation of property after a death, wills and the odd commercial dispute. Our OCI legal help and succession certificate pages cover the two most common requests.

Signing and apostilling documents in Trinidad and Tobago

Trinidad and Tobago has been a party to the Hague Apostille Convention since 2000, and India since 2005, so documents need an apostille rather than embassy legalisation. Affidavits, consents and powers of attorney are signed before a notary public or attorney-at-law, and the apostille is then obtained from the government office designated for the purpose, which has been the Ministry of Foreign and CARICOM Affairs. Confirm the current procedure and fees with that office before you sign, as administrative arrangements can change.

Civil documents such as birth, marriage and death certificates come from the Registrar General's Department and can be apostilled for use in India. For older records, especially those needed to trace an indentured ancestor, certified extracts may need to be obtained from archives first. Indian documents going the other way are apostilled by the Ministry of External Affairs in New Delhi after state-level verification; see our apostille and attestation page.

Most requested services from Trinidad and Tobago

These six services are the ones clients in Trinidad and Tobago ask for most. They range from OCI and documentation questions for the long-settled community to estate, property and judgment work for more recent migrants.

A reciprocating territory: what that means in practice

Trinidad and Tobago is one of the few countries notified by India as a reciprocating territory under section 44A CPC. A money decree from its superior courts can be filed for execution in the appropriate Indian district court with a certified copy and a certificate stating how far it has been satisfied. The Indian court treats it as if it were its own decree, subject to the objections in section 13, such as lack of jurisdiction, fraud or breach of natural justice.

This is a real advantage over countries such as the USA or Canada, where a fresh suit is needed. It applies to sums of money other than taxes, fines and penalties. Matrimonial orders and injunctions are not executed this way, and family decrees are still tested against Indian law. Details are on our foreign judgment enforcement page.

Estates, wills and tax links

Under section 5 of the Indian Succession Act, succession to immovable property in India is governed by Indian law, wherever the owner was domiciled, while movable property follows the law of domicile. So a Trinidadian resident who owns a flat in India should consider an Indian will or at least a will drafted to work under Indian law. Where a grant of probate or letters of administration has been issued by the High Court of Trinidad and Tobago, an Indian court can grant letters of administration with that will annexed under section 228, which saves proving the will afresh.

India and Trinidad and Tobago have a tax treaty, and an Indian resident's family members abroad should still check how Indian rent, interest and capital gains are taxed. Inheritances themselves are not taxed as income in India.

Working with us from Trinidad and Tobago

Trinidad and Tobago does not observe daylight saving, so India is always nine and a half hours ahead. A call at 7.30 am in Port of Spain is 5 pm in India, which suits both sides. Couriers to India take about a week, sometimes longer through regional hubs, so allow time for originals.

The High Commission of India in Port of Spain deals with OCI applications, passports and consular services. For court matters in India, video hearings are increasingly available, and most of the work on estates and mutation can be done through an attorney holder without anyone travelling from the Caribbean.

If you do plan a trip to India, tell us early. We can line up any step that needs you in person, such as signing before a sub-registrar or meeting a bank, so that one visit covers everything and you are not asked to return for a missed formality.

Frequently asked questions

Can a judgment from the High Court of Trinidad and Tobago be enforced in India?

Yes, if it is a money decree of a superior court. It can be executed directly in an Indian district court under section 44A CPC, subject to the defences in section 13.

Do documents from Trinidad need Indian High Commission attestation?

Generally no. Both countries are parties to the Apostille Convention, so an apostille from the designated Trinidad and Tobago office is sufficient.

My ancestors came as indentured labourers. Can I get an OCI card?

Possibly. OCI eligibility depends on proving descent from an eligible Indian ancestor. The Indian government announced in 2025 that eligibility for the Trinidad and Tobago community would extend to the sixth generation, so check current rules with the High Commission.

What records help prove Indian ancestry?

Emigration passes and ship registers from the indenture period, birth and marriage certificates linking each generation, and any old Indian documents held by the family. Name spellings often vary, so explanatory affidavits help.

Can I inherit property in India as a Trinidadian citizen?

Yes. Foreign nationals can inherit property in India from a person resident in India. Selling or transferring it later is subject to FEMA rules.

Will my Trinidad will cover my flat in India?

It may, if validly executed, but Indian law governs succession to the flat. A separate Indian will or careful drafting avoids problems in Indian courts.

Is there a time limit for executing a Trinidad judgment in India?

Act promptly. Limitation for execution and the conditions of section 44A should be reviewed as soon as the decree is final.

Do I need to come to India for a succession certificate?

Usually not. Consents and affidavits can be signed in Trinidad with an apostille, and counsel or an attorney holder handles the court.
