A US-based co-owner can seek partition of ancestral or joint property in India by family settlement or by a partition suit. A settlement deed can be signed by you through a power of attorney apostilled in your state. If others refuse, a suit is filed in the civil court where the property lies, and the court decides each share, divides the property by metes and bounds or orders a sale.

Partition of Family Property from the USA: how it works
We first work out each person's share under the Hindu Succession Act or the applicable personal law, taking into account that daughters have had equal coparcenary rights since the 2005 amendment, as confirmed by the Supreme Court in Vineeta Sharma (2020). We then try settlement: a family partition deed or a memorandum recording an earlier oral partition. Video calls bring together relatives in India and the US, and the draft goes back and forth by email. Your signature is given through a specific power of attorney or by signing the deed abroad and sending it for registration.
If settlement fails, we file a partition suit with a request for a preliminary decree declaring the shares. The court may appoint a local commissioner to inspect the property and propose a division. Where the property cannot be divided fairly, for instance a single house, the court can order a sale and division of proceeds under the Partition Act. Throughout the case, an injunction can prevent any co-owner from selling or building on the property in the meantime.
What clients in the USA should know
- A US-based co-owner's share does not shrink because they have lived abroad for decades; long absence matters only if someone proves ouster and adverse possession, which is hard.
- Proceeds you receive from a partition sale may be taxable both in India and the US, and the treaty credit is claimed on your US return.
- Agricultural land inherited by an OCI holder can be kept, but it can be sold only to an Indian citizen resident in India.

Questions from clients in the USA
Do all heirs have to agree to a family partition?
Yes, a family settlement needs everyone's signature. If even one heir refuses, the remaining heirs can file a partition suit.
Can I get my share in money instead of land?
Yes, by agreement with the others or by a court-ordered sale where the property cannot be divided without loss.
How long does a partition suit take?
Contested partition suits often take several years. Many settle once the preliminary decree fixes the shares.
