British Indians most often face Indian criminal proceedings arising from matrimonial complaints, cheque bounce cases or family property quarrels, frequently learning of them only when a Look Out Circular is flagged.

In short

If a case is filed against you in India while you live in the UK, you can seek anticipatory bail and, where the FIR is an abuse of process, ask the High Court to quash it. Your advocate acts through a vakalatnama attested by a UK notary and apostilled. If a Look Out Circular exists, it can be challenged or managed before you travel to India.

Criminal Defence & Look Out Circulars from the UK: how it works

We find out what exists: the FIR, the offences under the Bharatiya Nyaya Sanhita with old IPC equivalents, any summons or warrant, and whether an LOC has been issued. Anticipatory bail is sought under section 482 of the Bharatiya Nagarik Suraksha Sanhita (formerly section 438 CrPC). Courts may require you to join investigation, which can be planned with interim protection.

Where the case is baseless or the parties have settled, we petition the High Court under section 528 BNSS (formerly section 482 CrPC) to quash it. We also deal with passport impounding and travel permission. Because Indian proceedings can affect OCI status and UK immigration matters, we coordinate the timing of every step. A trip to India for a court date is planned only after protection is in place, and we brief you on what to expect at the airport and in court.

What clients in the UK should know

  • Check for an LOC before travelling if you know of any complaint; we can verify discreetly.
  • Extradition from the UK for ordinary private disputes is uncommon, but an open case affects travel and OCI status.
  • Settlements in matrimonial cases should be recorded in a way that allows the High Court to quash the FIR.
