Tenant Eviction for clients in Germany

Germany-based landlords letting a flat in Pune, Mumbai or Bengaluru often find Indian tenancy law slower and more fragmented than the German Mietrecht they know.

Tenant Eviction for clients in Germany
In short

A landlord in Germany can evict a tenant in India through the rent controller, rent authority or civil court, depending on the state law. Maharashtra's leave and licence rules, Karnataka's rent act and Punjab and Chandigarh's NRI own-use provision each work differently. You appoint an attorney holder by a power of attorney legalised in Germany, and we conduct the case.

Document route
German notary, pre-certification, then Indian mission attestation
Time difference
India is 3.5 hours (summer) to 4.5 hours (winter) ahead
Punjab NRI right
Section 13-B, East Punjab Urban Rent Restriction Act 1949
Without rent control
Notice under section 106, Transfer of Property Act

Tenant Eviction from Germany: how it works

We review the agreement, its registration and the rent history, then identify the governing law. In Maharashtra, a registered leave and licence agreement allows a faster summary remedy before the competent authority when the licence expires; in Karnataka and many other states, the rent act grounds apply; in Punjab and Chandigarh, an eligible NRI owner can use section 13-B for own use. A legal notice terminates the tenancy and demands arrears.

The case is filed in the right forum with ownership and tenancy evidence. Tenants are usually directed to deposit arrears and ongoing rent, which often leads to settlement. If contested, your affidavit is filed from Germany, with video testimony where allowed. After the order, execution restores possession, and we prepare a registered agreement for the next occupant. Where the tenant offers to leave in return for time or a partial waiver, we negotiate and have the terms recorded so they can be enforced without a new case.

What clients in Germany should know

  • In Mumbai and Pune, a registered leave and licence agreement gives a far quicker remedy than an ordinary tenancy.
  • An Indian tenant who pays rent to a landlord living in Germany is required to withhold tax and give you a TDS certificate.
  • Rental income from India is taxable in India and, under the treaty, also reportable in Germany.
