A legal heir living in Kuwait applies for a succession certificate in the district court where the deceased ordinarily resided or held the assets. The petition affidavit and vakalatnama are signed at the Embassy of India in Kuwait or authenticated by the Kuwaiti Ministry of Justice and attested by the Kuwait foreign ministry and the Embassy. Other heirs file consents, the court publishes notice, and the certificate issues if no objection succeeds.

Succession Certificate from Kuwait: how it works
We list each debt or security to be named in the certificate, with account numbers and values, because the court fee is based on the value covered. Death certificates, a legal heir or family membership certificate where the state issues one, and identity documents for all heirs are gathered. You sign in Kuwait, and heirs in India or other countries sign consent affidavits locally. If any heir is a minor, the court will want to know how the minor's share is protected.
After notice and publication, the court waits for objections. An uncontested petition is then heard and the certificate granted, usually on furnishing a security bond. Present the certificate to each bank, post office and registrar; they will transmit the assets to you. If the family also owns land, the certificate does not cover it, so mutation in revenue records is a separate step, which we can run alongside.
What clients in Kuwait should know
- Each document attested in Kuwait needs three stamps, the Ministry of Justice, the foreign ministry and the Embassy, unless you sign at the Embassy itself, which is usually quicker.
- Sums released to you should go to an NRO account; repatriation to Kuwait then follows within the annual USD 1 million limit with Forms 15CA and 15CB.
- Post office savings and older bank deposits often have spelling differences in names; an affidavit explaining the variations, attested in Kuwait, prevents objections.

Questions from clients in Kuwait
Can my brother in India apply instead of me?
Yes. Any heir can apply with consent from the others. You simply sign a no-objection affidavit attested in Kuwait.
Does the certificate cover my father's house?
No. A succession certificate covers debts and securities such as deposits and shares. Immovable property passes by inheritance and is recorded through mutation or probate where a will exists.
Will I have to attend court in India?
Usually not for an uncontested petition. Your lawyer appears and the court relies on attested affidavits.
