People and companies in South Africa can get most Indian legal work done remotely. Documents are signed before a South African notary and apostilled by a High Court registrar or by DIRCO in Pretoria, then couriered to India and stamped within three months. South Africa is not a reciprocating territory, so its court judgments need a fresh suit in India. India and South Africa have a tax treaty, and South African exchange control rules apply to money moved offshore.

South African Indians, new migrants and business links
Indentured labourers began arriving in Natal in 1860 to work on the sugar estates, followed by passenger Indians, many of them Gujarati traders, who paid their own way. Their descendants are today largely South African citizens, concentrated in KwaZulu-Natal and Gauteng, and most have no Indian citizenship in the family for several generations. A newer group of Indian professionals, doctors, engineers and business owners has arrived since the 1990s, and they usually remain Indian citizens with property and bank accounts at home.
That mix shapes the work. Older families ask about OCI eligibility and about houses or shops left in Gujarat by a grandparent. Newer migrants need powers of attorney, wills and succession work when a parent dies in India. South African companies in mining, financial services, retail and technology enter India through subsidiaries and joint ventures, and Indian groups operating in South Africa need contracts that work in both legal systems. We handle the Indian end of each.
Signing and apostilling documents in South Africa
South Africa is a party to the Hague Apostille Convention, as is India, so South African documents need an apostille rather than embassy legalisation. The usual route is:
- Sign before a South African notary public, an admitted attorney who also holds a notarial admission, with your passport or South African identity document.
- Obtain the apostille. Notarised documents are generally apostilled by the registrar of a High Court division, while public documents issued by national departments, such as unabridged birth certificates from Home Affairs, are apostilled by the legalisation section of DIRCO in Pretoria.
- Courier the original to India for stamping within three months of receipt.
Indian citizens may also have documents attested at the High Commission of India in Pretoria or the Consulates General in Johannesburg, Durban and Cape Town. For inheritance work, an unabridged certificate from the Department of Home Affairs is far more useful than an abridged one, because it shows the parents' names that Indian courts need to trace the line of descent.

Tax treaty and exchange control
India and South Africa have a comprehensive agreement for the avoidance of double taxation. A South African tax resident who receives Indian dividends, interest or fees can claim treaty rates with a certificate of residence from the South African Revenue Service and Form 10F filed in India. South Africa taxes its residents on worldwide income, so rent or gains from Indian property must also be declared to SARS, with credit for Indian tax under the treaty. Our page on repatriating funds from India explains the Indian steps.
Money moving out of South Africa is subject to exchange control administered through authorised dealer banks under the South African Reserve Bank's rules. Individuals have an annual discretionary allowance and can move larger amounts for foreign investment after obtaining a tax compliance status from SARS. South African companies investing in an Indian subsidiary also need to comply with these rules, so the South African side should be cleared before the Indian company is incorporated. On the Indian side, NRIs can repatriate up to USD 1 million per financial year from NRO accounts with Forms 15CA and 15CB.
Estates, wills and South African judgments in India
South African estates are administered under the supervision of the Master of the High Court, who issues letters of executorship to the executor. Those letters do not by themselves give authority over property or bank accounts in India. Indian assets need an Indian grant: probate or letters of administration where there is a will, or a succession certificate for debts and securities where there is not. A South African will is valid in India if it meets the formal requirements, but immovable property in India follows Indian law, so a separate Indian will is often the cleaner solution. See our page on wills and probate in India.
South Africa is not a reciprocating territory under section 44A of the Code of Civil Procedure. A South African money judgment can only be the basis of a fresh suit in India, where the defendant may raise the objections in section 13, such as lack of jurisdiction or a judgment not on the merits. South African divorce orders are recognised in India only if they meet the tests in Y. Narasimha Rao v. Y. Venkata Lakshmi, which look at the law under which the couple married and whether the respondent took part in the proceedings.
Practical points for clients in South Africa
South Africa is three and a half hours behind India throughout the year. A 9 am meeting in Johannesburg is 12.30 pm in Mohali, so the whole South African working morning overlaps with ours. Courier from South Africa to North India usually takes four to seven working days, and we always check scans first.
Many South African clients of Indian origin are surprised that their South African identity is not enough to inherit agricultural land in India smoothly. Indian law allows a person of Indian origin to inherit such land, but buying more is not permitted, and some states have their own restrictions. Families should also be aware that Indian revenue records may still show a great-grandparent's name, so several generations of succession may need to be proved before any sale. We explain these steps at the first call, so that expectations are realistic.

Frequently asked questions
Are South African apostilles accepted in India?
Yes. Both countries are parties to the Apostille Convention, so an apostille from a High Court registrar or DIRCO is accepted in India without embassy legalisation.
Can a South African court judgment be enforced in India?
Not directly. South Africa is not a reciprocating territory, so the judgment holder files a suit on the judgment in India, and the defendant can raise the objections in section 13.
My grandparents came from Gujarat. Can I get OCI?
If your grandparent was an Indian citizen on or after 26 January 1950, or eligible to be one, you may qualify. Families whose ancestors left in the indenture period are often beyond the great-grandchild limit.
Do South African letters of executorship work for Indian assets?
No. Indian banks and revenue offices need an Indian grant such as probate, letters of administration or a succession certificate.
Is there a tax treaty between India and South Africa?
Yes. South African residents can claim treaty relief on Indian income with a SARS certificate of residence and Form 10F.
Can a South African company own 100% of an Indian company?
In most sectors, yes, under the automatic route. Some sectors have caps or need approval. The South African exchange control steps must be cleared first.
How long does an Indian succession matter take from South Africa?
An unopposed succession certificate usually takes four to eight months; probate may take longer. Contested matters can take years.
Do I need to travel to India?
Usually not. Affidavits and powers of attorney are signed in South Africa, and we or your attorney holder attend Indian offices. Travel may be needed for some property registrations.
