Mutation & Transfer for clients in Canada

Families in Canada inheriting farmland or a house in India often leave the revenue record in a deceased parent's name, which blocks any sale and invites disputes.

Mutation & Transfer for clients in Canada
In short

Mutation updates the land or municipal record in your name after inheritance, gift or purchase. From Canada, heirs sign affidavits or a power of attorney before a notary or lawyer, apostilled by Global Affairs Canada or the provincial authority. We file the application in India, attend the hearing and obtain the updated record, without anyone needing to fly.

Mutation & Transfer from Canada: how it works

For inheritance without a will, the revenue office generally wants the death certificate, a family tree or legal heir certificate, identity proof of each heir, and the consent of heirs who are giving up their share or agreeing to a joint entry. A single affidavit format is prepared for every heir in Canada, the United States or India, and each signs where they live. Apostilled Canadian documents are now accepted directly, without consular attestation.

In Punjab, mutation is sanctioned by the revenue officer after a public notice and a hearing in the village or tehsil. Objections from relatives are not unusual, and we respond to them at the hearing. In cities, the municipal property tax record must be updated separately. Once mutation is sanctioned, we obtain a fresh jamabandi or property card showing your name, which you will need for any future sale, lease or loan.

What clients in Canada should know

  • A relinquishment deed is the cleaner way for one heir to give up their share to another; it must be registered and can be signed in Canada.
  • An inheritance is not taxed in India or Canada as income, but any later sale is subject to capital gains tax in both, with treaty credit.
  • Delay causes trouble: the longer a deceased owner's name stays on the record, the more heirs there are to trace.

Questions from clients in Canada

Can mutation be done online?

Many states accept applications online, but verification and the hearing still need representation on the ground.

What if my uncle objects to the mutation?

The revenue officer hears the objection. If it raises a genuine title dispute, the matter may be referred to the civil court.

Do I need a succession certificate for land?

No. Succession certificates cover debts and securities. Land passes by inheritance and is recorded through mutation.
