Mutation updates the revenue or municipal record to show the new owner after inheritance or sale. Heirs in Trinidad and Tobago apply through an attorney holder with the death certificate, proof of heirship such as a will, probate, succession certificate or legal heir certificate, and no-objection affidavits from other heirs, all apostilled where signed abroad. Mutation does not itself create title, but without it the property cannot easily be sold, mortgaged or taxed in the heirs' names.

Mutation & Transfer from Trinidad and Tobago: how it works
We identify the right office: the tehsil or revenue office for agricultural land, the municipal corporation or development authority for urban property, and the society or builder for apartments. Each has its own forms. Heirs in Trinidad sign affidavits and powers of attorney before a notary or attorney-at-law, and these are apostilled before being sent to India. If the death occurred in Trinidad, the death certificate from the Registrar General is apostilled too.
The office usually publishes a notice inviting objections, and a local inspection may follow. If another relative objects, the mutation officer may refer the parties to a civil court. Delays are common where earlier mutations were never done, so we sometimes regularise two or three generations at once. After mutation we update property tax, electricity and water accounts, which makes later sale or rental much easier.
What clients in Trinidad and Tobago should know
- Mutation entries are evidence of possession and liability for tax, not proof of title; disputed ownership is decided by civil courts.
- Heirs abroad should check records periodically, because a relative may obtain mutation by omitting overseas heirs.
- Selling inherited property as a foreign national requires the sale proceeds to pass through an NRO account.
