A landlord in Kuwait can evict a defaulting or overholding tenant in India through the rent controller or civil court, acting by a vakalatnama signed at the Embassy of India or attested through the Kuwaiti ministries. Grounds such as rent arrears, sub-letting, damage and the landlord's own need are available under the state rent law. Several states also give non-resident landlords a quicker route to recover possession for their own use.

Tenant Eviction from Kuwait: how it works
We begin with the tenancy documents: the lease or rent agreement, whether it was registered, rent receipts and the tenant's correspondence. A notice terminating the tenancy and demanding arrears is sent first. If the tenant does not vacate, we file an eviction petition before the rent controller or a civil suit, depending on the state law and whether the premises are covered by rent control. You sign a vakalatnama and affidavit in Kuwait, and a relative can hold a power of attorney to show the property to the court commissioner if needed.
Rent cases can be slow, but courts can order the tenant to deposit arrears and current rent while the case continues, which often encourages settlement. Some states, including Punjab, provide a special summary route for a non-resident landlord who needs the premises for personal use on return. Avoid self-help: cutting electricity or changing locks exposes the landlord to criminal complaints. For the future, a registered lease under the Model Tenancy Act framework, where adopted, gives clearer remedies.
What clients in Kuwait should know
- Rent received from your Indian tenant is taxable in India, and a tenant paying a non-resident landlord may be required to deduct tax at source.
- If you plan to return from Kuwait when your contract ends, mention this in the petition, because a genuine personal need is a recognised ground in most rent laws.
- Caretaker or relative tenants with no written agreement are common in Gulf families' homes; these need careful handling, as the occupant may claim ownership or a family share.

Questions from clients in Kuwait
My tenant has not paid for a year. Can I evict without coming from Kuwait?
Yes. Arrears are a standard eviction ground, and your lawyer and attorney holder can conduct the case while you give evidence by affidavit or video.
There was no written rent agreement. Can I still evict?
Yes, an oral tenancy can be proved by rent payments and other evidence, though a written agreement makes things easier.
Can I just change the locks when the tenant is away?
No. That is illegal self-help and can lead to criminal complaints. Possession must be recovered through the court.
