Mutation updates the revenue record to show you as the owner after inheritance, gift or purchase. From the US, you sign an application and an affidavit, or a power of attorney for a relative or our team, before a notary and get a state apostille. We file with the local revenue office or municipal body, attend the hearing and follow up until the record changes.

Mutation & Transfer from the USA: how it works
The documents depend on how the property came to you. For inheritance without a will, we need the death certificate, proof of the family tree and consent or no-objection statements from the other heirs, many of whom may also be in the US. For a will, the original or a certified copy and sometimes probate are needed. We prepare one set of affidavits that each heir signs before a notary in their own state, and the apostilles are obtained from the respective Secretaries of State. The originals travel to India by courier.
Revenue offices in Punjab, Haryana and most other states issue a notice and hold a short hearing before sanctioning mutation. Our team attends, answers objections and obtains the updated record. Municipal property tax records in cities are updated separately and we handle both. Remember that mutation is evidence of possession and tax liability, not a title document; if another relative disputes the inheritance, a civil court decides title, and we advise on that route as well.
What clients in the USA should know
- Getting mutation done while all heirs are cooperative is far easier than after one of them has sold or mortgaged their share.
- An inheritance itself is not taxed in India, but a US person who receives foreign inheritance above the IRS threshold must report it on Form 3520.
- Many states now allow mutation applications online; the hearing and verification still need someone on the ground, which our team provides.

Questions from clients in the USA
Can mutation be done if my siblings are in different US states?
Yes. Each signs the affidavit before a local notary and obtains an apostille from their own state. We coordinate the set.
Is mutation the same as transferring title?
No. Title passes by inheritance, will or registered deed. Mutation records that change in the revenue or municipal records.
How long does mutation take?
Usually one to four months after filing, depending on the office and whether any objection is raised.
