Divorce for NRIs for clients in Qatar
In short

A Qatar-based NRI can obtain a divorce in an Indian family court, by mutual consent or on contested grounds, under the personal law that governs the marriage. The spouse in Qatar signs the petition and affidavits through the Qatari attestation chain or at the Embassy of India, and many family courts allow appearance by video. For Muslim marriages, talaq, khula and mubarat are recognised, but instant triple talaq is void.

Divorce for NRIs from Qatar: how it works

For Hindu, Sikh, Jain and Buddhist couples, mutual consent divorce under section 13B of the Hindu Marriage Act is usually the quickest route, with the waiting period waivable in suitable cases following Amardeep Singh (2017). Christian couples use the Divorce Act 1869, and those married under the Special Marriage Act use its provisions. Maintenance, return of gold and dowry articles, custody and property are settled in one agreement recorded by the court.

For Muslim couples, divorce must follow a recognised procedure; the Muslim Women (Protection of Rights on Marriage) Act 2019 makes instant triple talaq void and an offence. A wife can seek divorce under the Dissolution of Muslim Marriages Act 1939, and khula and mubarat are available. We explain which route applies and how the spouse in Qatar can take part without losing work days.

What clients in Qatar should know

  • A divorce granted in Qatar between Indian nationals may face recognition questions in India; an Indian decree avoids them.
  • A wife in India can claim maintenance under section 144 BNSS (formerly section 125 CrPC) against a husband in Qatar.
  • Court dates needing personal presence can often be fixed during annual leave.
