In short

People in Austria get Indian legal work done by signing documents before an Austrian notary, obtaining an apostille from the competent Austrian authority and sending the original to India, where it is stamped within three months. No Indian embassy attestation is needed because the apostille is in force between India and Austria. Business matters such as branch offices and contracts are handled online, and Indian court hearings can usually be joined by video from Austria.

The Indian community and Austrian business in India

Indians have lived in Austria for decades. One well-known early group was nurses from Kerala who came to Vienna's hospitals from the 1970s, and their children are now Austrian professionals. Vienna also hosts several United Nations organisations, which bring Indian staff on international contracts, and there is a growing number of engineers, IT specialists and students. Because Austria generally does not allow dual citizenship, many people of Indian origin there hold Austrian passports and Overseas Citizen of India cards.

That history shapes the legal questions we see: older family members with property in Kerala, Punjab or Gujarat, second-generation owners who inherited land they have never visited, powers of attorney for siblings in India, and marriages and divorces involving one spouse in each country.

On the business side, Austrian companies are strong in machinery, rail and tunnelling, environmental technology, electrical equipment and specialist manufacturing. Many enter India with a liaison or project office before committing to a subsidiary, and contracts with Indian distributors, EPC contractors and suppliers follow. See our pages on branch and liaison offices and commercial contracts.

Notaries and apostilles in Austria

Austria has a civil law notary profession. An Austrian notary (Notar) can certify your signature on a power of attorney, affidavit or declaration, and certify copies of documents. Bring your passport; the notary may ask for the document to be explained if it is in English, so a short cover note from us helps.

Austria and India are both parties to the Hague Apostille Convention, and the convention is in force between them. Which Austrian office issues the apostille depends on the document:

DocumentUsual apostille authority in Austria
Notarised power of attorney or declaration, court documentsThe president of the competent regional court (Landesgericht)
Documents issued by federal ministriesThe Federal Ministry for European and International Affairs
Civil status and other provincial administrative documentsThe office of the provincial government or the authority it designates

Check the exact office with the notary or the issuing authority, since arrangements can change. Documents in German need an English translation for use in India, and Indian documents for use in Austria usually need an MEA apostille and a certified German translation. The Embassy of India in Vienna can also attest documents if an Indian office insists on consular attestation.

Most requested services from Austria

From Austria the requests split between companies and families. Austrian businesses ask about liaison and branch offices and about contracts with Indian partners; individuals and OCI holders ask about powers of attorney, apostilles, buying or selling property and divorces involving India.

Tax treaty and moving money between Austria and India

India and Austria have a double taxation avoidance agreement. It sets the rules for taxing dividends, interest, royalties, fees for technical services, business profits and capital gains, and it allows relief in the country of residence. Austrian residents claim treaty benefits in India with a tax residency certificate from the Austrian tax authorities and Form 10F on the Indian portal.

For Austrian companies with an Indian branch or project office, the important questions are permanent establishment and how profits are attributed. A liaison office that stays within its permitted activities should not create taxable profits, but an office that negotiates and concludes sales may. For individuals, rent and interest from India and gains on selling property are taxed in India, and Austria then deals with relief under its own rules. Proceeds can be moved from an NRO account to Austria up to USD 1 million per financial year with Forms 15CA and 15CB.

Divorce, family law and Austrian judgments

Austria is not a reciprocating territory under section 44A CPC. An Austrian judgment for money must be sued on afresh in India, and the Indian court will test it under section 13 CPC.

Many Austrian divorces are consensual divorces granted by a district court (Bezirksgericht) under section 55a of the Austrian Marriage Act, after the spouses agree on maintenance, property and children. Indian courts recognise foreign matrimonial decrees on the principles in Y. Narasimha Rao v. Y. Venkata Lakshmi (1991). A decree where both spouses took part and consented has a much better chance of recognition than a decree obtained against an absent spouse. If the marriage was solemnised in India under the Hindu Marriage Act and one spouse may need to prove the divorce in India, a mutual consent divorce under section 13B in India is often simpler; see our page on divorce for NRIs.

India is not a party to the Hague Child Abduction Convention. If a child is taken from Austria to India, Austrian return orders are not enforced automatically, and Indian courts decide custody on the welfare of the child, though they give weight to the foreign court's order.

Practical points for clients in Austria

India is four and a half hours ahead of Austria in winter and three and a half hours ahead during European summer time. Our mornings overlap with the early Austrian day and our afternoons with Austrian late morning, so calls are easy to arrange without anyone working at night.

Indian courts permit hearings and evidence by video link under their video conferencing rules. Parties in Austria usually join from home or from a lawyer's office, subject to the court's directions. Documents sent by international courier from Austria reach Punjab in about a week. Keep your OCI card details, Indian PAN and passport copies ready, because nearly every Indian office will ask for them.

ProudLegal works from Mohali, India, and has no office in Austria. For Austrian law questions, such as Austrian inheritance procedure (Verlassenschaftsverfahren) or Austrian employment law, we coordinate with your Austrian lawyer or notary. Clients with family in Germany should note that the apostille is not in force between India and Germany; see our Germany page.

Frequently asked questions

Can an Austrian notary certify my signature for an Indian property document?

Yes. An Austrian notary certifies the signature, and the apostille is then added by the competent Austrian authority. We draft the document in English to meet Indian stamp and registration rules before you sign.

Do I need Indian embassy attestation as well as an apostille?

Normally no. The apostille is in force between Austria and India. A few Indian offices still ask for consular attestation out of habit; we usually resolve this, and the Embassy in Vienna is a fallback.

Can I keep my Indian property after becoming an Austrian citizen?

Yes. Property you owned or inherited remains yours. As an OCI cardholder you can also buy residential and commercial property, but not agricultural land, plantations or farmhouses, unless you inherit them.

Is an Austrian divorce valid in India?

It can be, depending on the grounds, how the case was conducted and whether both spouses took part. Consensual divorces under section 55a of the Austrian Marriage Act are more readily accepted. We review the decree before you rely on it in India.

Can an Austrian company open a liaison office in India?

Yes, if it meets the track record and net worth conditions, through an application to an authorised dealer bank under FEMA. The office can represent the company but cannot earn income in India.

Does India have a tax treaty with Austria?

Yes. The India-Austria double taxation avoidance agreement applies, and benefits are claimed with an Austrian tax residency certificate and Form 10F.

Can an Austrian judgment be enforced in India?

Not by direct execution. Austria is not a reciprocating territory, so the judgment holder files a fresh suit in India based on the judgment.

How quickly can you start?

Usually within a few days of receiving your documents and instructions. Where a power of attorney is needed, allow a week or two for the Austrian notary, apostille and courier.
