Property dispute lawyer for NRIs and OCI cardholders

A property dispute in India is harder when you are eight time zones away. Relatives, caretakers and forgers rely on your absence. We run the case from India through a properly executed power of attorney, so you travel only when it genuinely matters.

NRI property dispute in India handled by a lawyer through a power of attorney executed abroad
Quick answer

An NRI can pursue or defend a property dispute in India without living there. You sign a special power of attorney before a notary in your country, get it apostilled or attested by the Indian mission, and it is stamped in India within three months of arrival. Your attorney holder and lawyer then file the suit, complaint or reply. Your own evidence can usually be recorded by video conferencing or through a court commission, so travel is limited or avoided.

The disputes we see most often for owners abroad

Property owned by someone outside India attracts a familiar set of problems. Most fall into one of these groups, and each has a different remedy:

  • Family disputes. A sibling or cousin living in the house claims it was gifted to them, refuses to share rent from ancestral land, or resists partition. See our page on partition of family property.
  • Occupation by others. A caretaker, tenant or neighbour stays on and starts claiming ownership. We deal with this in detail under illegal possession recovery.
  • Forgery and fraudulent sale. Someone impersonates the owner, uses a fake power of attorney or a forged signature, and registers a sale deed. These cases need both a civil suit to cancel the deed and a criminal complaint.
  • Boundary and revenue disputes. Wrong entries in revenue records, encroachment by a neighbour, or a mutation entered without notice to you.
  • Builder and developer disputes. Delayed possession or a cancelled allotment, usually handled before RERA rather than in a civil court.

The first task is always to identify which forum gives you the quickest effective remedy. A civil court, a revenue officer, the police, RERA and a consumer commission each have their own powers, and filing in the wrong place costs years.

Running the case through a power of attorney signed abroad

You do not need to fly to India to start a case. You execute a special power of attorney in favour of a trusted person in India, usually a relative or a professional attorney holder. It should name the property, the proceedings, and exactly what the attorney may do: sign pleadings, file complaints, appear before officers, depose as to facts within their knowledge, and engage lawyers.

How it is signed depends on where you live:

Where you signUsual formalityNotes

Non-apostille countries (for example UAE, Qatar, Kuwait)Notary or local authentication, then attestation at the Indian embassy or consulateMany clients sign directly before the consular officer
GermanyAttestation by the Indian missionIndia's apostille relationship with Germany is not in force because of Germany's objection

Once the original reaches India it must be stamped under the Indian Stamp Act within three months of its first receipt in India, usually by adjudication at the Collector's office. Section 33 of the Registration Act 1908 recognises powers of attorney authenticated by a notary or Indian consul abroad. Where the attorney will present a sale or other deed for registration, the sub-registrar will expect the power of attorney itself to meet these requirements, and several states require such powers to be registered.

One limit is important. An attorney holder can depose only about facts within their own knowledge. They cannot give evidence on your behalf about events only you witnessed. That is why your own testimony is planned separately.

Giving evidence without travelling

Indian courts now routinely record evidence by video conferencing under the video conferencing rules framed by each High Court. Your examination-in-chief is filed as an affidavit under Order XVIII of the Civil Procedure Code, and cross-examination can take place over a video link, usually from an Indian mission, a notary's office or another location the court approves. Courts also have power under Order XXVI CPC to issue a commission to examine a witness who lives abroad.

We apply for these facilities early, because the other side sometimes opposes them to force you to travel. We schedule your sessions around your time zone wherever the court allows, and we prepare you by video beforehand so that the first time you see the documents is not in the witness box.

Time limits and adverse possession

Delay is the most common reason owners abroad lose property. The key periods under the Limitation Act 1963 are:

  • Possession based on title (Article 65): 12 years from the date the other person's possession became adverse to you. Adverse possession must be open, continuous and hostile to your title, and the burden of proving it is on the person claiming it.
  • Possession based on earlier possession (Article 64): 12 years from dispossession.
  • Summary suit under section 6 of the Specific Relief Act: within six months of dispossession, without having to prove title.
  • Cancellation of a forged or fraudulent deed (Article 59): three years from when you first learnt of the facts.

Possession by a tenant, licensee or caretaker is permissive and does not become adverse merely by lapse of time. Possession by one co-owner is, in law, possession on behalf of all co-owners, unless there is a clear ouster of the others. These rules protect many absent owners, but they need evidence: rent receipts, caretaker agreements, letters, and tax payments in your name.

Police complaints and NRI cells

Where the dispute involves forgery, impersonation or criminal trespass, a criminal complaint runs alongside the civil case. Relevant offences under the Bharatiya Nyaya Sanhita 2023 include cheating (section 318, formerly IPC 420), forgery and using forged documents (sections 336, 338 and 340, formerly IPC 465, 467 and 471), and criminal trespass (section 329, formerly IPC 441 to 448). If the police do not register an FIR, a complaint can be made to the Magistrate seeking a direction for investigation under section 175(3) of the Bharatiya Nagarik Suraksha Sanhita (formerly CrPC 156(3)).

Several states have dedicated channels for NRI grievances. In Punjab, the NRI Affairs Department runs NRI police stations and an NRI wing of the police, and the Punjab State Commission for NRIs hears complaints about NRI property. These bodies can push a stalled complaint forward, but they do not decide title. A civil court decree is still what finally secures the property.

How we decide the strategy

Before anything is filed, we collect the title chain, revenue records and any documents the other side has registered, and we run a fresh encumbrance search. We then advise in writing on three questions: what remedy is available, where it should be filed, and what the realistic timeline and cost are. Often the right first step is a legal notice, an injunction application to stop a further sale, or a caveat to prevent an ex parte order against you.

Many family disputes end in a registered settlement or relinquishment once the other side sees a properly prepared case. Where they do not, we take the suit to trial and, after a decree, to execution, which is where possession is actually handed back.

Fees and realistic timelines

Court fee in a civil suit is set by each state and, in suits for possession or declaration, often depends on the value of the property, so it can be significant. Stamp duty on adjudication of the power of attorney is modest in most states. Our professional fees are quoted in writing, stage by stage: notice, filing, interim applications, evidence, arguments and execution.

Interim relief such as an injunction can often be obtained within weeks. A contested civil suit commonly takes several years at trial level, which is why early injunctions, mediation and a well-documented case matter so much.

Documents you need

Scans are enough to start. We will tell you which originals must be sent to India and when.

  • Your passport and OCI card or foreign passport copy
  • Title documents: sale deed, gift deed, will or partition deed
  • Revenue records: jamabandi, fard, khasra or property card
  • Property tax and utility bills in your name
  • Any documents registered by the other party
  • Photographs and correspondence showing the dispute
  • Details of the attorney holder in India

Frequently asked questions

Do I have to come to India for my property case?

Usually not for filing and most hearings. Your attorney holder and lawyer can handle these. Your personal evidence can often be recorded by video conferencing, though a court may occasionally require personal attendance.

Can my attorney holder give evidence for me?

Only about facts within their own knowledge. Facts that only you know, such as a conversation or a payment you made, must come from your own testimony.

My relative has been living in my house for 15 years. Have I lost it?

Not necessarily. Possession that began with your permission is not adverse possession, and a co-owner cannot claim adverse possession without a clear ouster. The relative must prove hostile possession for 12 years.

Is an apostilled power of attorney valid in India?

Yes, for documents from countries where the Apostille Convention is in force with India. It must still be stamped in India within three months of arrival.

Someone sold my property using a fake power of attorney. What now?

File a suit to cancel the sale deed and for injunction, and a criminal complaint for forgery and cheating. Act quickly; the suit for cancellation should be filed within three years of learning of the fraud.

Can I file a complaint with the NRI police online?

Several state NRI cells accept complaints by email or online portals. We prepare the complaint with supporting documents so it is not returned for want of detail.

How long will my property case take?

Interim orders can come within weeks, but contested civil suits often take several years. Settlement, mediation and early injunctions shorten the practical timeline.

How will you keep me updated?

After each hearing we send a short written note and the next date by email or WhatsApp, and we hold video calls at times that suit your time zone.
