If an FIR or complaint has been filed against you in India while you live in the US, you can seek anticipatory bail and, where the case is baseless, quashing of the FIR by the High Court, without being arrested on arrival. Your advocate files through an apostilled vakalatnama. If a Look Out Circular has been issued, it can be challenged or its effect managed before you travel.

Criminal Defence & Look Out Circulars from the USA: how it works
We first find out exactly what exists: the FIR copy, the sections invoked under the Bharatiya Nyaya Sanhita (with the old IPC numbers), whether a summons or warrant has issued and whether an LOC is in force. We check the e-courts portal and the state police website. Anticipatory bail under section 482 of the Bharatiya Nagarik Suraksha Sanhita (formerly section 438 CrPC) is filed in the sessions court or High Court. Courts often require the accused to join investigation, which can be arranged on a planned visit with interim protection in place.
Where the FIR is an abuse of process, for example a matrimonial complaint naming every relative in the US, we petition the High Court under section 528 BNSS (formerly section 482 CrPC) for quashing. If an LOC is issued, we challenge it or seek permission to travel. US citizens with OCI cards should know that an Indian criminal case can affect OCI status in serious cases, so we deal with that risk early.
What clients in the USA should know
- Never travel to India without checking whether an LOC exists if you know of any complaint against you; we can verify this quietly first.
- Courts generally need your presence at some stage, but interim protection lets you make that visit safely.
- Indian police cannot arrest you in the US; extradition for ordinary disputes is rare, but an open case affects travel, OCI and US immigration matters.

Questions from clients in the USA
Can I get anticipatory bail while in the US?
Yes. Courts entertain anticipatory bail applications from accused persons abroad, often with conditions such as joining the investigation on arrival.
Will an LOC stop me leaving India?
It can. If an LOC is in force, immigration may detain you on arrival or stop you leaving, so we deal with it before you travel.
Can the FIR be quashed if we settle?
In matrimonial and many private disputes, the High Court can quash an FIR on the basis of a genuine settlement between the parties.
