Mutation & Transfer for clients in Malaysia

Malaysian families often find that their ancestors' land in Tamil Nadu or Kerala is still recorded in a great-grandparent's name, which makes it hard to sell, lease or protect.

Mutation & Transfer for clients in Malaysia
In short

Heirs in Malaysia can have inherited land recorded in their names without travelling. In Tamil Nadu, this is done through a patta transfer by the Tahsildar; in other states through mutation in the relevant revenue register. Heirs sign consents and affidavits before a Malaysian notary, authenticated at Wisma Putra and attested by the High Commission. With proof of descent and death certificates for each generation, an attorney holder or our team applies to the revenue office.

Mutation & Transfer from Malaysia: how it works

We trace the chain of inheritance from the recorded owner to the present heirs, obtaining death certificates and legal heir certificates for each generation where possible. Where older records are missing, affidavits and family trees fill the gaps. Heirs in Malaysia sign consents and affidavits through the attestation chain, and those who wish to give up their share sign a relinquishment deed. We obtain the current patta, chitta, adangal and encumbrance certificate to confirm the property's status.

The patta transfer application is filed online through the Tamil Nadu e-services portal or at the taluk office. The revenue officer may inspect the land and issue notice to interested parties. Uncontested applications are generally processed within a few months. If there is an objection or a gap in the chain of title, the officer may require a court decree. Once the patta is in the heirs' names, they can deal with the land, though a sale requires further documentation.

What clients in Malaysia should know

  • Death certificates for ancestors who died in Malaysia decades ago may need to be obtained from the National Registration Department and attested through Wisma Putra and the High Commission.
  • A patta records the person liable for land revenue and is strong evidence of possession, but ownership still depends on the underlying title and succession.
  • Joint pattas in the names of many heirs are common, and a partition deed or decree may be needed before one heir can sell a defined portion.

Questions from clients in Malaysia

What is a patta?

A patta is the revenue record in Tamil Nadu showing who holds the land and pays land revenue. Transferring it into the heirs' names is the equivalent of mutation.

Can we transfer the patta if our ancestor died in Malaysia?

Yes, with an attested Malaysian death certificate and proof of the heirs' relationship. We prepare the supporting affidavits.

Do all heirs need to agree?

Usually yes. If some heirs object, the transfer may be refused until the dispute is settled or decided by a court.
