Power of Attorney for clients in Poland

Most Indians in Poland cannot fly home for every property visit, bank instruction or court date. A power of attorney signed in Poland lets a trusted person act for you in India.

Power of Attorney for clients in Poland
In short

A power of attorney for India signed in Poland is executed before a Polish notary, who certifies your signature, and then apostilled by the Polish Ministry of Foreign Affairs. Embassy attestation is not needed because the apostille is in force between the two countries. In India the original is stamped within three months of arrival, and a power to sell or buy property may also need registration under state law. We draft the power in English to fit the task.

Power of Attorney from Poland: how it works

Tell us what the attorney must do and where. We draft a specific power naming the property or case and listing each permitted act. You take it to a notary in Warsaw, Krakow, Wroclaw or wherever you live; because the document is in English, the notary may want to understand its content, so a short Polish summary helps. The notary certifies your signature and identity. You then apply to the Ministry of Foreign Affairs for the apostille, which can usually be done by post, and courier the original to India.

In India we arrange stamp duty under the relevant state's law and, where needed, registration of the power. Sub-registrars and banks check details carefully: your name must match your passport and title documents, and photographs and thumb impressions may be required. If a Polish notary adds a Polish certificate, that is fine. After the task is done, consider revoking the power formally so it cannot be reused.

What clients in Poland should know

  • Polish notaries charge regulated fees for signature certification; the apostille fee is separate and paid to the Ministry.
  • The Embassy of India in Warsaw can attest a power directly if an Indian office prefers consular attestation, but this is usually unnecessary.
  • If you hold a Polish residence card rather than a Polish passport, sign as an Indian citizen and give your Indian passport details.

Questions from clients in Poland

Does the power need to be translated into Polish?

No. It stays in English for use in India. A Polish summary only helps the notary understand it.

Can I use an electronic signature from Poland?

Not for Indian property matters. A wet-ink signature certified by the notary is needed.

How long does it take?

One notary appointment, a few days to a few weeks for the apostille depending on the Ministry's workload, and about a week of courier.
