Power of Attorney for clients in Sweden

Indians living in Sweden often need a parent, sibling or friend to act for them in India. A notarius publicus can certify the signature and apostille the document in one visit.

Power of Attorney for clients in Sweden
In short

If you live in Sweden, your Indian power of attorney is drafted in English by an Indian lawyer, signed before a notarius publicus who certifies your identity and signature, and apostilled by the same notary. No Indian embassy attestation is needed. The original is couriered to India and stamped under the relevant state stamp law within three months. For property work, the sub-registrar may verify or record the document before your attorney holder uses it.

Power of Attorney from Sweden: how it works

We prepare a specific power of attorney for what needs doing: selling a flat in Hyderabad, letting property in Chandigarh, dealing with a bank or attending a court. You book a notarius publicus, often available at law firms and notary offices in Stockholm, Gothenburg, Malmo and Uppsala, and sign in front of them with your passport. They add their certificate and apostille. If you hold Swedish citizenship and an OCI card, the document should say so, with both passport and OCI numbers.

Once in India, the original is stamped. Duty is lower for powers given to close relatives in many states and higher for unrelated persons, especially where a power to sell is included. Some sub-registrar offices ask for a fresh photograph or confirmation from the principal at the time of use. Keep the powers narrow, set an end date where practical, and revoke old powers before giving new ones. Your attorney holder should not deal with the property in ways the document does not cover.

What clients in Sweden should know

  • Sweden permits dual citizenship but India does not; describing yourself as an Indian citizen after naturalisation can invalidate documents and cause passport issues.
  • Swedish digital identity (BankID) signatures are not accepted for Indian property powers of attorney; a wet-ink signature before the notary is required.
  • Notary fees in Sweden are set by each notary, so ask for the cost of certification and apostille together.

Questions from clients in Sweden

Can the Embassy of India in Stockholm attest my power of attorney instead?

Yes, embassy attestation is also accepted, but the notarius publicus apostille is usually quicker.

Can one power of attorney cover two properties?

Yes, if both are clearly described, though separate documents for different states are often simpler.

Is a scanned copy enough for the sub-registrar?

No. The original apostilled and stamped document is needed.
