A power of attorney for India signed in Denmark is executed before the notarial office of a Danish district court and then apostilled by the Danish Ministry of Foreign Affairs. Because the apostille relationship with India is in force, no Indian embassy attestation is required. Once the original reaches India, stamp duty must be paid within three months, and a power for selling immovable property may need registration depending on the state. We draft it so it meets these rules.
- Document route
- District court notary, then Danish MFA apostille
- Time difference
- IST is 3.5 to 4.5 hours ahead
- Recognition
- Section 33, Registration Act 1908
- Authentication
- Indian mission, or notary plus apostille
Power of Attorney from Denmark: how it works
We draft the power of attorney after understanding exactly what your attorney holder must do. A special power for one property sale or one court case is safer and more readily accepted than a broad general power. The draft names you, the attorney, the property or matter, and each act authorised. You print it, book an appointment with the district court notary (notarial services are part of the Danish court system), sign in person with your passport and photographs where the draft needs them, and then send it to the Ministry of Foreign Affairs for the apostille. The original is couriered to India.
In India the document is adjudicated and stamped under the state stamp law within three months of its receipt. If the attorney will sell or buy land, many sub-registrars require the power itself to be registered or verified, and some states have specific rules on powers executed abroad. Watch that the names exactly match your passport and title documents, that photographs and thumb impressions are included where the state expects them, and that the attorney holder understands the limits of the authority.
What clients in Denmark should know
- Danish MitID electronic signatures are not accepted by Indian sub-registrars for property powers; a wet-ink signature at the district court is needed.
- The Embassy of India in Copenhagen can also attest a power of attorney, which some clients prefer if their Indian bank or registrar insists on consular attestation.
- If you revoke the power, do it in writing and notify the attorney and any office that holds a copy; revocation also needs to reach India in a legally usable form.

Questions from clients in Denmark
Can I sign the power of attorney at the Indian Embassy in Copenhagen instead?
Yes. Consular attestation at the Embassy is an alternative to a Danish notary plus apostille. Either route is legally valid; the choice depends on appointment availability and what your Indian office prefers.
Does the document have to be in Danish?
No. Draft it in English for use in India. The district court notary certifies your signature and may add a Danish certification text, which is fine.
How long is a power of attorney valid?
Until it is revoked, completed or ends on a date you choose. Many offices in India prefer a recent power, so if yours is several years old we may suggest a fresh one.
