A power of attorney for India can be signed in Italy either before a notaio, followed by an apostille from the Procura della Repubblica, or before a consular officer at the Embassy of India in Rome or the Consulate General in Milan. Both are accepted. The original is sent to India and stamped within three months of receipt, and for property work it is presented to the sub-registrar with the attorney holder's identity proof.

Power of Attorney from Italy: how it works
We draft the power of attorney in English, or in English and Punjabi if your attorney holder prefers, naming the exact village, khasra numbers, house address, bank or case. A general power of attorney covering everything is often refused or treated with suspicion by tehsil offices, so we usually prepare a special power for each purpose. You then choose where to sign. An Italian notaio will want to understand the document and may need an interpreter; the notarised procura then goes to the Procura della Repubblica for the apostille. The Indian mission route avoids the interpreter and apostille steps but requires an appointment.
When the original reaches Punjab or elsewhere in India, we have it stamped and check it with the office that will use it. Sub-registrars in Punjab may ask for a photograph and identity proof of the principal and a confirmation letter. If the power is used to sell land, the money must go into your NRO account, tax must be deducted by the buyer, and you should keep copies for your Italian tax adviser. Choose your attorney holder carefully and revoke the power when the work is done.
What clients in Italy should know
- Agricultural land sales in Punjab often need a fresh fard (copy of the jamabandi) and a no-dues certificate; your attorney holder can obtain these once the power is accepted.
- Italian notaries record the document in Italian; ask for a bilingual text with English prevailing so that Indian offices do not need a separate translation.
- Never sign blank papers or a power of attorney in favour of a property dealer you do not know; most fraud complaints we see from Italy start with such documents.

Questions from clients in Italy
Which is faster for me in Brescia: the notaio or the Consulate in Milan?
It depends on appointment availability. The Consulate route avoids the Procura apostille step, while a notaio may be available sooner. We prepare the document so it suits either.
Can my father sell my land in Punjab using the power of attorney?
Yes, if the power expressly allows sale and is properly attested and stamped. The sale money must be paid into your account, not his.
Can I cancel a power of attorney I gave years ago?
Yes. Sign a revocation deed in Italy through the same route, notify the attorney holder and inform the sub-registrar and any bank where it was used.
