International Arbitration for clients in Singapore

Disputes under contracts with Indian counterparties are often referred to Singapore-seated arbitration, but the award has to be enforced or resisted in India, where the losing party's assets usually are.

International Arbitration for clients in Singapore
In short

An award from a Singapore-seated arbitration, including one under the SIAC Rules, is a foreign award enforceable in India under Part II of the Arbitration and Conciliation Act. The award holder applies to the High Court with jurisdiction over the assets; the court may refuse enforcement only on the limited grounds in section 48. Indian courts can also grant interim relief in aid of Singapore arbitration under section 9, unless the parties have excluded it.

International Arbitration from Singapore: how it works

Before or during the arbitration, we advise on Indian law issues: whether interim relief in India is needed to preserve assets, whether an emergency arbitrator's order will be respected, and how to frame the claim so that the award is enforceable. Indian courts have held that emergency arbitrator orders in India-seated arbitrations are enforceable, but foreign-seated emergency orders still generally need a section 9 application. We coordinate with your Singapore counsel throughout.

After the award, we file an enforcement petition in the commercial division of the High Court with the original award or certified copy, the arbitration agreement and any translation. The other party may raise objections under section 48, such as invalidity of the agreement, lack of proper notice or conflict with the public policy of India, which is narrowly construed. Once objections are dismissed, the award is deemed a decree and executed against the debtor's Indian assets through attachment, sale or garnishee orders.

What clients in Singapore should know

  • Indian courts cannot set aside a Singapore-seated award; challenges belong in the Singapore courts, while India decides only on enforcement.
  • Public policy as a ground for refusing enforcement is narrow after the 2015 amendment and does not permit a review of the merits.
  • Arbitration clauses that state a Singapore seat clearly avoid the confusion seen in older Indian cases over seat and venue.
